Product-specific usage terms for BugGapp, presented inside the KaSa23 website.
BugGapp Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the BugGapp mobile application, related exports, websites, content, tools, and related services made available by KaSa23 LLC (“KaSa23,” “we,” “us,” or “our”) under the BugGapp product name (collectively, the “BugGapp Services”).
BugGapp is a KaSa23 product. Where applicable, these Terms should be read together with the broader KaSa23 LLC Terms of Service. If there is a conflict between these BugGapp Terms and the KaSa23 LLC Terms of Service, these BugGapp Terms control for your use of BugGapp, and the KaSa23 LLC Terms of Service control for matters not specifically addressed here.
By accessing or using BugGapp, you agree to these Terms. If you do not agree, do not use BugGapp.
1. Eligibility
You may use BugGapp only if you are legally able to enter into a binding agreement and are not prohibited from using the BugGapp Services under applicable law.
If you use BugGapp on behalf of a company, organization, client, or other entity, you represent and warrant that you have authority to bind that entity to these Terms, and “you” includes that entity.
2. What BugGapp Is
BugGapp is a mobile bug review and export tool designed to help users review mobile web experiences, capture issues in context, annotate issue locations, record bug metadata, and generate structured exports such as screenshots, CSV files, Markdown files, ZIP packages, and related bug-report materials.
BugGapp may allow you to:
- enter and load a URL or other web destination for review
- review a mobile web experience within the app
- mark an issue on-screen
- add notes, severity, priority, and related issue details
- export bug reports and supporting materials
- unlock additional export functionality through ads, one-time purchases, or other monetization features made available by us
BugGapp is a capture-and-handoff tool. It is not a warranty, certification, compliance, accessibility, performance, or security testing service.
3. Accounts and Access
Some BugGapp features may require an account, device permissions, app-store access, or other technical prerequisites.
You agree to:
- provide accurate and current information where required
- keep your credentials and device access secure
- remain responsible for activity under your account or device session
- notify us promptly of unauthorized use or suspected security issues
We may suspend, restrict, or terminate access where reasonably necessary for security, legal, operational, policy, fraud-prevention, or abuse-prevention reasons.
4. Acceptable Use
You may use BugGapp only in compliance with these Terms and applicable law.
You may not:
- use BugGapp for unlawful, fraudulent, deceptive, invasive, or unauthorized activity
- test, review, access, or export material from websites, applications, or systems where you do not have the right to do so
- use BugGapp to capture, store, transmit, or share content in violation of confidentiality, privacy, intellectual property, contractual, or other legal obligations
- attempt to gain unauthorized access to BugGapp, related systems, or third-party sites loaded through BugGapp
- interfere with or disrupt the BugGapp Services or related infrastructure
- reverse engineer, decompile, disassemble, or attempt to extract source code, except where applicable law prohibits restricting that right
- bypass or circumvent security, access, or monetization controls
- scrape, crawl, or automate misuse of the BugGapp Services except as authorized by us
- upload, transmit, or distribute malware, malicious code, or harmful content
- use BugGapp to harass, abuse, threaten, or harm others
- use BugGapp in a way that could impair service performance or availability
- misrepresent your identity, affiliation, authority, or review rights
- use BugGapp or its outputs to build a competing product through unauthorized copying, extraction, or misuse of the BugGapp Services
We may investigate suspected violations and take any action we consider appropriate, including restricting exports, suspending access, terminating accounts, removing content, reporting to authorities, or pursuing legal remedies.
5. Review Rights and Responsibility for Third-Party Sites
BugGapp may allow you to load and review websites, staging environments, previews, demos, or other web content that is owned or controlled by you or by third parties.
You are solely responsible for ensuring that you have the legal right and operational authorization to access, review, capture, annotate, export, store, and share content from any site or service you load into BugGapp.
You acknowledge and agree that:
- BugGapp does not verify whether you have permission to review a given site
- BugGapp is not responsible for the content, availability, legality, or security of third-party sites
- you are responsible for complying with confidentiality obligations, testing policies, platform rules, employment obligations, and applicable law when using BugGapp
- exporting screenshots or bug packages may capture confidential, personal, proprietary, or regulated information, and you are responsible for how that information is handled
6. User Content and Exports
BugGapp may allow you to create, upload, store, generate, export, or share content, materials, notes, screenshots, bug reports, metadata, URLs, project names, annotations, and related information (“User Content”).
You retain whatever rights you have in your User Content, subject to the rights you grant below.
You grant KaSa23 a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, adapt, process, transmit, display, perform, distribute, and otherwise use User Content as reasonably necessary to:
- provide, operate, maintain, and improve BugGapp
- support export, sync, storage, restoration, troubleshooting, and related functionality
- develop, test, improve, and protect current and future features
- prevent fraud, abuse, spam, misuse, and security threats
- comply with law and enforce these Terms
- protect BugGapp, KaSa23, our rights, and our users
You represent and warrant that:
- you own or control the necessary rights in your User Content
- you have the right to capture and export the reviewed content
- your User Content and use of BugGapp do not violate applicable law or third-party rights
- your User Content does not violate these Terms
We are not obligated to monitor User Content, but we may review, remove, disable, or restrict User Content at our discretion where appropriate.
7. Local Capture, Exports, and Data Handling
BugGapp may generate screenshots, annotations, structured issue files, ZIP packages, CSV exports, Markdown exports, and similar materials on your device or through related BugGapp functionality.
You acknowledge that:
- exports may contain sensitive or confidential information from the sites you review
- annotations, coordinates, screenshots, and metadata may not perfectly reflect every issue or screen state
- exports may be incomplete, corrupted, outdated, or affected by device, rendering, network, permission, or third-party behavior
- you are responsible for reviewing exports before relying on, sharing, or acting on them
You are solely responsible for how exported files are stored, transmitted, shared, retained, secured, or deleted after export.
8. Purchases, Billing, Refunds, and Restore
Some BugGapp features may be offered for free, behind an ad gate, as a one-time purchase, through in-app purchases, or under other pricing structures described at the point of use.
BugGapp may, for example, offer free users access to certain export functionality after viewing an advertisement and may offer a one-time Pro unlock or similar paid upgrade for expanded or ad-free functionality.
8.1 Apple-billed purchases
If you obtain a paid BugGapp feature through Apple’s App Store or an Apple in-app purchase flow:
- your purchase is processed by Apple, not directly by KaSa23
- payment will be charged to the Apple Account associated with your purchase confirmation
- Apple’s terms, billing rules, and refund procedures also apply
- KaSa23 does not control Apple’s billing systems, payment methods, or refund approval decisions
Apple states that some App Store purchases may be eligible for refunds through Apple’s refund process, and that refund eligibility can vary by country or region. Apple also states that users can request a refund through Apple’s Report a Problem flow and that users retain rights provided by applicable consumer protection laws where required.
8.2 Refund handling
Except where required by applicable law, or where a storefront’s mandatory terms provide otherwise, fees are non-refundable.
For Apple-billed purchases, refund requests should generally be submitted to Apple through Apple’s support and refund channels, including Apple’s Report a Problem flow. KaSa23 cannot independently issue, guarantee, or compel refunds for purchases billed by Apple. Apple determines whether a refund request is approved or denied under its own policies and applicable law.
8.3 Restore
If BugGapp offers a restorable non-consumable purchase, such as a one-time Pro unlock, you may be able to restore that purchase using the restore mechanism made available in the app, subject to Apple’s systems and your use of the same Apple Account used for the original purchase. Apple states that non-consumable purchases may be restorable and that apps must include a restore mechanism for restorable purchases. Apple also notes that consumable purchases cannot be restored.
We do not guarantee uninterrupted entitlement restoration. Restore behavior may be affected by Apple account status, receipt validation, device state, network conditions, or third-party store issues.
8.4 Ads and purchase availability
Ad availability is not guaranteed. Free export paths that depend on ad delivery may be unavailable at times due to third-party ad, network, regional, inventory, policy, or technical limitations.
Pricing may change prospectively to the extent permitted by law. Failure of payment processing, restore, verification, or entitlement systems may delay or affect access.
9. Third-Party Services
BugGapp may rely on or integrate with third-party services, including app stores, advertising providers, analytics tools, web-rendering technologies, hosting providers, crash reporting tools, SDKs, payment processors, export libraries, or external websites loaded by you.
We do not control and are not responsible for third-party services or third-party content. Your use of third-party services is subject to their own terms, conditions, and privacy policies.
Without limitation, sites you choose to review through BugGapp are third-party services unless they are provided directly by KaSa23.
10. AI-Supported or Automated Features
BugGapp or related KaSa23 Services may include AI-supported, machine-assisted, algorithmic, or automated features, including features related to issue structuring, classification, summarization, prioritization, or export formatting.
You acknowledge that:
- automated outputs may be incomplete, inaccurate, inconsistent, or inappropriate
- outputs may vary between uses
- automated outputs may require human review and correction
- you are responsible for evaluating outputs before relying on them
KaSa23 does not guarantee that automated outputs will be accurate, complete, reliable, or fit for your intended purpose.
11. Feedback
If you provide suggestions, ideas, comments, test notes, improvement requests, or other feedback regarding BugGapp (“Feedback”), you grant KaSa23 a worldwide, perpetual, irrevocable, royalty-free, fully paid, sublicensable, and transferable right to use, reproduce, modify, distribute, and otherwise exploit that Feedback for any purpose without compensation or obligation to you.
12. Intellectual Property
The BugGapp Services, including their design, software, interfaces, workflows, visual elements, text, graphics, logos, trademarks, service marks, compilations, export templates, and other content, are owned by KaSa23 or its licensors and are protected by intellectual property and other laws.
Except for the limited rights expressly granted in these Terms, no rights are granted to you by implication or otherwise.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use BugGapp for its intended purpose.
You may not use KaSa23 or BugGapp names, logos, branding, or proprietary materials without prior written permission, except as allowed by law.
13. Beta Features
We may designate certain BugGapp features as beta, preview, early access, experimental, or similar.
Such features may be incomplete, unstable, or subject to additional restrictions. We may modify or discontinue beta features at any time. Beta features may be provided with reduced or no support and may be subject to additional terms.
14. Service Availability
We do not guarantee that BugGapp will always be available, uninterrupted, error-free, or secure.
BugGapp may be unavailable or degraded from time to time due to maintenance, device limitations, operating-system behavior, outages, network failures, third-party failures, advertising unavailability, export failures, rendering inconsistencies, website incompatibilities, or other causes.
We may impose limits on use, storage, exports, features, device compatibility, or access at our discretion.
15. Consumer Rights
Nothing in these Terms is intended to exclude, limit, or waive any rights or remedies that cannot be excluded, limited, or waived under applicable law.
If you are entitled to mandatory consumer rights under the law of your jurisdiction, including rights relating to digital products, statutory guarantees, conformity requirements, refunds, or remedies, those rights apply notwithstanding anything to the contrary in these Terms.
Where applicable law does not permit a disclaimer, limitation, exclusion, class-action waiver, forum-selection clause, or other term to apply in full, that term will apply only to the maximum extent permitted by law.
16. Disclaimers
THE BUGGAPP SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND WITH ALL FAULTS TO THE MAXIMUM EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KASA23 AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, SUPPLIERS, AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AVAILABILITY, RELIABILITY, SECURITY, AND THAT THE BUGGAPP SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
WITHOUT LIMITING THE FOREGOING, KASA23 DOES NOT WARRANT THAT:
- BUGGAPP WILL DETECT, RECORD, OR EXPORT EVERY ISSUE
- SCREENSHOTS, ANNOTATIONS, OR EXPORTED FILES WILL BE ACCURATE, COMPLETE, OR RELIABLE
- BUG REPORTS WILL BE SUFFICIENT FOR ENGINEERING, QA, LEGAL, COMPLIANCE, SECURITY, ACCESSIBILITY, OR RELEASE DECISIONS
- THIRD-PARTY SITES WILL RENDER CORRECTLY IN BUGGAPP
- DEFECTS WILL BE CORRECTED
- CONTENT OR DATA WILL NOT BE LOST, CORRUPTED, OR EXPOSED
Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KASA23 AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR USE, ARISING OUT OF OR RELATED TO BUGGAPP OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF KASA23 FOR ALL CLAIMS ARISING OUT OF OR RELATING TO BUGGAPP OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID TO KASA23 FOR BUGGAPP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR
- USD $100
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
18. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless KaSa23 and its officers, members, employees, contractors, affiliates, licensors, suppliers, and service providers from and against any claims, demands, actions, proceedings, liabilities, damages, judgments, settlements, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- your use of BugGapp
- your review of any third-party site, application, or content
- your User Content or exports
- your violation of these Terms
- your violation of applicable law
- your violation of any confidentiality duty or rights of a third party
KaSa23 reserves the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate.
19. Privacy
Your use of BugGapp is also governed by the applicable KaSa23 and BugGapp privacy disclosures and policies, as updated from time to time.
20. Export, Sanctions, and Compliance
You may not use, export, re-export, transfer, or provide access to BugGapp except as authorized by applicable law, including export control and sanctions laws.
You represent and warrant that you are not located in, under the control of, or a resident of any country or territory subject to comprehensive restrictions applicable to the BugGapp Services, and that you are not on any applicable restricted party list.
21. Termination
You may stop using BugGapp at any time.
We may suspend, restrict, or terminate your access to all or part of BugGapp at any time, with or without notice, if:
- you violate these Terms
- we suspect fraud, abuse, unlawful activity, or security risk
- we are required to do so by law
- providing BugGapp to you becomes impractical, commercially unreasonable, or operationally undesirable
- we discontinue BugGapp or the relevant feature
Upon termination, rights granted to you under these Terms will cease. Sections that by their nature should survive termination will survive, including sections relating to intellectual property, feedback, disclaimers, limitations of liability, indemnity, dispute terms, and general provisions.
22. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles.
22.1 Informal dispute process
Before either party files a claim against the other, the party seeking relief will send a written notice describing the dispute and the requested resolution.

If we do not resolve the dispute informally within 30 days after notice is sent, either party may bring a formal claim, subject to the rest of this Section 22.
22.2 Forum
Except to the extent applicable law provides otherwise, any dispute, claim, or controversy arising out of or relating to BugGapp or these Terms will be brought exclusively in the state or federal courts located in New York, and you consent to the personal jurisdiction and venue of those courts.
22.3 Small claims and injunctive relief
Nothing in these Terms prevents either party from:
- bringing an eligible claim in small claims court, if that claim qualifies
- seeking temporary, preliminary, or other equitable relief as necessary to protect intellectual property, confidential information, security, or other rights pending final resolution
22.4 No class actions
To the extent permitted by law, you and KaSa23 agree that any dispute will be resolved on an individual basis only, and not as part of any class, consolidated, collective, or representative action.
23. Changes to These Terms
We may update these Terms from time to time. The updated version will become effective when posted, unless otherwise stated. Your continued use of BugGapp after the effective date of updated Terms constitutes acceptance of the updated Terms to the extent permitted by law.
If required by law, we will provide additional notice of material changes.
24. General Terms
These Terms, together with any policies, addenda, supplemental terms, and the KaSa23 LLC Terms of Service where applicable, form the entire agreement between you and KaSa23 regarding BugGapp.
If any provision of these Terms is held unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
KaSa23’s failure to enforce any provision is not a waiver of its right to do so later.
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign or transfer these Terms and our rights and obligations under them without restriction, to the extent permitted by law.
The section titles in these Terms are for convenience only and have no legal effect.
